Article 1: General Provisions
These Terms and Conditions ("Terms") apply to any order placed by a visitor to this website ("Customer") at Audio Limburg. Placing an order through the webshop of Audio Limburg means that the customer has consulted these Terms and expressly accepts the applicability of these Terms, to the exclusion of all other conditions. Additional conditions are excluded from the customer, unless a prior and explicit written acceptance by Audio Limburg.
Article 2: Price
All prices are expressed in EURO, always including VAT and all other taxes required by the customer. If delivery, reservation or administration fees are charged, this will be indicated separately.
The stated price refers only to the articles as described in writing. The accompanying photo is decorative and can contain elements or articles that are not included in the price.
Article 3: Offer
Each offer is only open to customers who are resident in the European Union. The articles are intended for normal domestic use.
Despite the fact that the catalog and the website are made with the utmost care, it is still possible that the information is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Audio Limburg. Audio Limburg is,what the accuracy and completeness of the information offered, only bound to an obligation of means. Audio Limburg is in no way liable in the event of material errors or printing errors.
If you have specific questions, for example about sizes, color, availability, delivery, or delivery method, we ask you kindly to contact Audio Limburg.
The offer is valid while supplies last and can be modified or withdrawn at any time by Audio Limburg. Audio Limburg cannot be held responsible for the unavailability of a product.
Article 4: Online Purchases
4.1 Order procedure
When the customer finds a product he wants to buy, he chooses desired delivery method for each item. To place the article in the shopping cart the customer clicks on the knop'In cart. When the customer has placed the desired number of items in his cart, he clicks on the shopping cart at the top of the page to get an overview of the installed products.
The customer can now view all selected items in his shopping cart with the stated delivery costs and total cost. While viewing the shopping cart, the customer has the ability to modify products and / or remove them. By clicking on the "Checkout" button, the customer continues with the completion of his order.
Before the client can proceed to the payment options, he must accept the 'Terms and Conditions'. This is done by checking the text box.
4.2 Payment Methods
The customer can choose between the following payment methods: VISA / Mastercard, iDEAL, Bancontact/Mistercash, Sofortbanking and transfer to account number BE57 1030 2770 9635.
The acquisition is concluded at the moment that the customer will receive a confirmation email from Audio Limburg.
4.3.1 When will my order be shipped?
Your order will normally be processed within 24 hours . You will always receive an email containing the precise date of shipment and the estimate date of delivery.
Packages are generally (depending on their delivery status) dispatched within 24 hours after receipt of payment and you will receive an email containing a track-and-trace-link, in order for you to trace your order.
Shipment and delivery of packages will always take place on workdays from Monday until Friday (National holidays excluded).
4.3.2 Delivery statuses
- In Stock - green: These goods can be delivered immediately within one or two days.
- In Stock - Orange: These goods have a delivery time of thereto four days.
- Out of Stock: The estimate time of delivery will be placed by each product separately.
In the event of a changed delivery time, Audio Limburg will do all that is necessary to change the delivery status on a product page as soon as possible. Customers who already ordered that product wil be informed by mail of the changed delivery time.
4.3.3 How will my order be delivered?
Products with a weight up to 30 kg will be delivered by Bpost. Goods can be delivered at home, at a Bpost pick-up point (only available in Belgium) or at a Bpost Parcel locker (only available in Belgium). By placing an order you can choose from one of these three delivery methods.
Delivery of products with a weight over 30 kg will be carried out by our own courier services. Delivery will always take place from Monday until Friday, between 8.00 h and 18.00 h. (National holidays excluded). The evening prior to delivery you will receive an SMS or email stating the dates between which delivery is scheduled. So you do not need to stay at home the whole day, waiting for your order. However, make sure that you, the very day of delivery, can be reached at the phone number you provided us.
Shipment and delivery of packages will always take place on workdays from Monday until Friday (National holidays excluded).
4.3.4 To which countries will my order be shipped?
Products from Audio Limburg will be shipped worldwide.
4.3.5 Shipping costs
- Belgium-The Netherlands: order < 25€ = 5€
- Belgium-The Netherlands: order > 25€ = 0€
- Europe (EU member states): order < 25€ = 5€
- Europa (EU member states): order > 25€ = 0€
- Rest of the world: order < 500€ = 150€
- Rest of the world: order > 500€ < 1000€ = 125€
- Rest of the world: order > 1000€ < 1500€ = 100€
- Rest of the world: order > 1500€ < 2000€ = 75€
- Rest of the world: order > 2000€ < 2500€ = 50€
- Rest of the world: order > 2500€ < 3000€ = 25€
- Rest of the world: order > 3000€ = 0€
ATTENTION: Shipping outside the European Union will be handled according to the Incoterm DAP (Delivered At Place). Which means that Audio Limburg will handle the delivery to the place of destiny, while the buyer is responsible for import clearance and any applicable local taxes or import duties.
4.3.5 Store pick-up
Goods can be picked-up in our store located at Sint-Jorislaan 124, BE-3540 Schulen (Herk-de-Stad). Collection can be done during our opening hours.
Article 5: Ownership
The delivered goods remain the exclusive property of Audio Limburg until the moment of full payment by the customer.
The risk for loss or damages, however, shall pass to the customer the moment of delivery. The customer agrees, if necessary, to designate a third party on the retention of Audio Limburg, for example to anyone who would seize the not yet fully paid articles.
Article 6: Penalties for non-payment
Without prejudice to the exercise of any other rights available to Audio Limburg, the customer bears, in case of non or late payment from the date of the breach of contract and without notice an interest at 10% per annum on the unpaid amount. Furthermore, the client shall be due, automatically and without notice, a lump sum compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.
Without prejudice to the foregoing, Audio Limburg has the right to not take (fully) paid items back.
Article 7: Guarantee
7.1 Legal guarantee
Under the Act of September 21, 2004 on the protection of consumers in consumer sales, the consumer has legal rights. Each article is subject to the legal warranty from the date of purchase (or delivery) to the first owner. Any commercial guarantee conditions are without prejudice.
To invoke the warranty, the customer must present proof of purchase.
For products that were purchased online and are delivered at the customer, the customer must, prior to iets claim, take contact with Audio Limburg after which the customer should return the purchased product, at own expense, to Audio Limburg.
Any defect must be reported by the customer within 2 months of its adoption. Afterwards, all rights to repair or replacement are waved.
The guarantee does not apply to defects that arise as a result of accidents, neglect, falls, abnormal or incorrect use, use of the product inconsistent with the purpose for which it was designed, failure to follow the operating or manual instructions, adjustments or changes to the article, rough use, poor maintenance, abnormal or incorrect use.
Neither does it apply to products with a shorter life span, or wear and tear items.
Defects that manifest themselves after a period of 6 months from the date of purchase or delivery shall be deemed to have no latent defects, subject to proof by the customer.
The warranty is not transferable.
Article 8: Right of Withdrawal
The provisions of this Article shall apply only to customers making online purchases in their capacity as consumer.
The consumer has, in accordance with the Law of April 6, 2010 relating to market practices and consumer protection, the right to communicate to Audio Limburg that he renounces the purchase without penalty and without giving any reason within 14 calendar days from the day following on the delivery of the good or the conclusion of the service agreement. Used, installed, damaged or incomplete devices are not reversed.
Customers who wish to use their right of withdrawal, must within 14 days after delivery, notify Audio Limburg, via an unequivocal statement (eg written letter sent by post, fax or email) that they wish to terminate the agreement. Customers can make use of the attached withdrawal form, but are not obliged to do so.
The customer has to return the goods within 20 days from delivery of the goods at their cost to Audio Limburg, Sint-Jorislaan 124, BE-3540 Schulen (Herk-de-STad).
Goods with a retail price of 100 euros or more must be returned by courier (DHL, FEDEX, …).
The customer may not use the products during the withdrawal period. If the returned product is damaged or reduced in value in one way or another, Audio Limburg reserves the right to claim damages for any loss caused by the customer.
Only items that are in their original packaging, along with all accessories, instructions and invoice or sales receipt can be returned. For reasons of hygiene, the return of ear pads and in-ear eartips is excluded.
Unless otherwise agreed, the customer cannot exercise the right of withdrawal for contracts:
- for the provision of services if performance has begun with the consent of the customer before the end of the withdrawal period;
- relating to the supply of goods created to the specifications of the customer or are clearly personalized or products which, due to their nature, can not be returned or spoil or become obsolete; (eg., cartrigdes, pickup stylus,….)
- for the supply of audio or video recordings or computer software which were unsealed by the customer; and
- for the supply of newspapers, periodicals and magazines.
After positive confirmation of the goods’ sound condition you will receive a refund corresponding to the value of the concerned goods including the original shipping cost (from Webshop to customer) as quickly as possible. Your refund will be transferred to you using the same payment method as initially used. Please note that we cannot influence the transaction duration of the third party payment provider (e.g. Visa, Mastercard etc.).
Article 9: Privacy
Audio Limburg, Sint-Jorislaan 124, Be-3540 Schulen (Herk-de-Stad), respects the Belgian law of December 8, 1992 regarding the protection of privacy in the processing of personal data.
The personal data communicated by you will be used for the following purposes: customer management, process order or quotation request, marketing purposes.
You have a legal right to inspect and correct personal data. Subject to proof of identity (copy identity card) you can via a written, dated and signed request to Audio Limburg, Sint-Jorislaan 124, BE-3540 Schulen (Herk-de-Stad), info at audiolimburg.com, request a free written notice of your personal data. If necessary, you can also ask to correct information that is inaccurate, incomplete or irrelevant.

Your personal data will not be passed to third parties.
Audio Limburg can collect anonymous or aggregated data of a non-personal nature, such as browser type, IP address, operating system you use or domain name of the website from which you came to this website, or through which you leave it. This enables us to optimize our website permanently for our users.
During a visit to the site, 'cookies' are placed on the hard drive of your computer. A cookie is a plain text file placed by the server of a website in the browser of your computer or on your mobile device when you access a website. Cookies cannot be used to identify individuals, a cookie can only identify a machine.

Article 11: Encroachment validity - Non-renunciation
If any provision of these Terms be invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by Audio Limburg to enforce any of the rights set out in these Terms and Conditions, or any right of this exercise, will never be seen as a waiver of such provision and will never corrode the validity of these rights.
Article 12: Amendments to the conditions
These Terms will be supplemented by other terms which explicitly refers to, and the general conditions of Audio Limburg. In case of contradiction, the present Terms and Conditions prevail.
Audio Limburg can always without notice change these Terms. Any purchase after the amendment, implies an acceptance by the customer of this new Policy.
Article 13: Evidence
The customer accepts that electronic communications and backups can serve as evidence.
Article 14: Applicable law - Jurisdiction
The Belgian law is applicable with the exception of the rules of private international law concerning applicable law and the Rome I Regulation on the International Sale of Goods. In case of disputes, only the courts in Hasselt are competent.
